• ANNEX 1 - MANDATORY CONDITIONS

   

  Sale of Alcohol

   

  1)              No supply of alcohol may be made under the premises licence:             

               

                a) at a time when there is no designated premises supervisor in respect of the premises licence; or             

  b) at a time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.             

               

  2)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.             

   

  3)              (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

  (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  Embedded Restrictions (para 6(8) Schedule 8 Licensing Act 2003)

   

  Alcohol shall not be sold or supplied except during permitted hours.  In this condition, permitted hours means:

   

  a) On weekdays, other than Christmas Day, 8.00am to 11.00pm;

  b) On Sundays, other than Christmas Day, 10.00am to 10.30pm;

  c) On Christmas Day, 12 noon to 3.00pm and 7.00pm to 10.30pm;

  d) On Good Friday, 8.00am to 10.30pm.

   

  The above restrictions do not prohibit:

   

  a) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;

  b) the sale of alcohol to a trader or club for the purposes of the trade or club;

  c) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.

   

  Alcohol shall not be sold in an open container or be consumed in the licensed premises.

   

   

   

   

   

• ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

  The Licensing Sub-Committee on 10 March 2009 determined that the following conditions be added to the Premises Licence for Lyndale Spar:

   

  1. The premises shall implement and enforce a ‘Challenge-25’ Policy

   

  2. Refresher training is to be given to all staff every six (6) months, as well as when there is a change in legislation. Such training should be varied and not consist of the same test, using a combination of methods such as verbal, written and an appropriate package such as SWECOTS ‘No ID - No Sale’ or an equivalent training package.

   

  3. Records of training (showing the training provided and an acknowledgement that the person being trained has understood the training) should be dated and signed by the individual being trained and such records should be kept at the premises and produced for immediate inspection when required.

   

  4. Only cards bearing the PASS hologram ID, photograph driving licences or passports shall be accepted as proof of age.

   

  5. A challenges and refusals register shall be kept at the premises and must be signed off at least once a month to ensure all members of staff are using it when necessary.

   

  6. Notices shall be displayed at the entrance to the store to ensure that all customers that enter the store are aware of the ‘Challenge-25’ Policy.

   

  7. Staff training shall adhere to the principles highlighted in the training CD-ROM package ‘No ID No Sale’ issued by trading standards or an equivalent training package.

   

  8. Staff training shall be conducted as soon as possible and the Designated Premises Supervisor shall provide written confirmation to the Council’s Licensing Manager when such training has been completed.

   

   

   

   

   

   

• ANNEX 4 - PLANS

   

  The hand drawn plan submitted as part of an application to convert an existing licence to a premises licence under Schedule 8 to the Licensing Act 2003 dated 8th August 2005 forms part of this licence and should be read in conjunction with it.
