Film Exhibitions The admission of children must be restricted as follows: 1) Where the film being exhibited has been classified by a body designated under section 4 of the Video Recordings Act 1984, admission of children ie. persons under 18 is restricted in accordance with any recommendation made by that body. 2) Where the film being exhibited has been classified by the licensing authority itself, the admission of children ie. persons under 18 is restricted in accordance with any recommendation made by the licensing authority.
Refer to 2 plans dated June 2005, numbered AV-475 (1) and AV - 475 (2) drawn by Peter North and Partners on a scale of 1:100 for Admiral Taverns with the licensable areas highlighted in red (submitted as part of an application to vary an existing premises licence under Section 17 to the Licensing Act 2003 dated 25th October 2005) which forms part of this licence and should be read in conjunction with it.
Sale of Alcohol 1) No supply of alcohol may be made under the premises licence: a) at a time when there is no designated premises supervisor in respect of the premises licence; or b) at a time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended. 2) Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence. 3) (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises. (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children: (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to: (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or (ii) drink as much alcohol as possible (whether within a time limit or otherwise); (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act); (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less; (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on: (i) the outcome of a race, competition or other event or process, or (ii) the likelihood of anything occurring or not occurring; (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner. 4) The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability). 5) The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available. 6) (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol. (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark. 7) The responsible person shall ensure that: (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures:- (i) beer or cider ½ pint; (ii) gin, rum, vodka or whisky 25ml or 35ml; (iii) still wine in a glass 125ml; and (b) customers are made aware of the availability of these measures.
Crime and Disorder (1) The holder of the premises licence will ensure that there is a specific period of 30 minutes between when licensable activities cease and the premises closes. (2) The premises shall be conducted at all times decently, soberly and in an orderly manner. No offensive or obscene performances shall be permitted. (3) An effective CCTV system shall be installed on the premises and maintained in good working order at all times with a minimum of 28 days continuous recordings. There must be sufficient cameras able to cope with operating illumination and located to cover all public areas. The cameras covering the entrances must be to identification standard, with the remainder capable of recognition. There shall be sufficient members of trained staff available during the hours of operation to be able to copy/download recordings at the request of the police or an authorised officer. (4) There shall be no party or event which specifically caters for persons under the age of 18. (5) All staff will be trained upon induction and at least every 6 months thereafter, regarding their lawful & social responsibilities for the sale of alcohol. A written record of training will be kept and made available upon request to the police or an authorised officer. (6) All incidents shall be recorded in writing in a log, retained for at least 12 months and produced at the request of the police or an authorised officer. Public Safety (7) The holder of the premises licence will ensure that all fire-fighting equipment on the premises is serviced and maintained so as to be available for use at any time. (8) The holder of the premises licence will ensure that all escape routes are kept unobstructed, free of trip` hazards and are clearly identified. (9) a record of all safety checks, tests, examinations, fire drills and / or accidents are kept in a Log Book. (10) All steps shall be taken as respect the structure and layout of the premises and the equipment provided therein to reduce danger to life from fire as in the opinion of the Fire Authority are reasonable having regard to the number of persons likely to use the premises. (11) No alterations or additions shall be made to the premises without prior notification of at least 21 days to the Fire Authority. Prevention of Public Nuisance (12) The holder of the premises licence will ensure that the Designated Premises Supervisor, or other appropriate person with responsibility for the day to day running of the premises, will receive and respond to all complaints throughout the duration of noisy events. (13) The holder of the premises licence will ensure that prominent and clear notices / instructions are displayed at all relevant exit points instructing customers / staff to respect the needs of local residents and not to cause unnecessary noise when they leave the premises. (14) The holder of the premises licence will ensure that no customers take glasses or open bottles from the premises (apart from off sales) (15) Each external door opening from the area covered by the Licence to the outside must be kept closed whilst music or any amplified sound is being played/produced. If the external doors are required for the entrance or exit of clients, there must be a lobby to prevent breakout of noise with at least one set of internal doors and at no time shall both the external and internal doors be open at the same time. No measures whatsoever, whether by pinning back, propping open or other means, are to be taken to keep either set of doors open. All openable windows must be kept closed at all times when the amplified music/sound is being generated within the premises. As a result of this condition it may be necessary to provide mechanical ventilation to the premises. If this is so it will be essential to install the ventilation system in such a way that it does not allow any noise generated within the premises to escape. Any system should be designed in conjunction with a suitably qualified person and approved by the Environmental Health Manager. (16) Where amplified music (either recorded or live) or a film is being played a tamper-proof sound limiting device must be installed at the premises to the level set in agreement with the Council. All amplified music (either recorded or live) played on the premises must be subject to the control of the sound limiting device. Protection of Children from Harm (17) The holder of the premises licence will ensure that: (a) proof of age is required for any sale / supply of alcohol that takes place where there is a suspicion on the part of the person selling or supplying the alcohol that the customer is under 18 years of age; (b) such proof of age conforms to the PASS accreditation system, photo driving licence, student cards and passports.
