ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
General
1) The Club shall operate as a non-proprietary membership club with rules (“the Club”). A copy of the rules of the Club must be deposited with the licensing authority and the Police and any change, amendment or variation to the rules must also be notified to the licensing authority and the Police within 14 days of the same being approved in accordance with the said rules.
2) The sale and supply of alcohol shall be restricted to the following categories of persons:
2.1) Members of the Club who have been members for at least two days or whose nomination for membership was made at least two days before his admission.
2.2) Persons who have been admitted to the premises as bona fide guests of a member who satisfies 2.1 hereof, provided that the number of guests introduced by a member on any one occasion shall not exceed two persons.
2.3) Members of any other club being part of the National Association of Railway Clubs (or its successor association) provided that a valid membership card is produced. Such a person may not admit guests to the premises.
2.4) Non-members who are attending a pre-arranged function at the premises that is restricted to individuals invited in advance by the organiser and whose names have been recorded in a visitors’ register on admission or in accordance with condition 5 below.
2.5) Members of the public attending any function at the premises that has been organised by the Club, provided that the principal purpose of the function is charitable or benevolent in nature or intended as a fund-raising exercise for a local community organisation or a charitable organisation.
3) No sale or supply of alcohol or consumption off the premises shall be permitted other than the supply of alcohol as a prize in a raffle, draw or as a prize in a competition such as a quiz and then provided only that the alcohol is supplied in a sealed container.
4) A list of all members’ names and addresses and a register of guests and visitors shall be maintained and kept at the Club and made available for inspection by the licensing authority and any authorised officer at any time the Club is open.
5) The responsible person will obtain a guest list of all non-members attending any function at the Club (other than functions organised by the Club itself) no less than 48 hours prior to the event. The responsible person will ensure that only invited guests as per the list shall be permitted entry and a copy of the list showing who has attended shall be kept with the visitors register.
Prevention of Crime and Disorder
6) No performance shall take place involving striptease, nudity or semi-nudity.
7) In respect of all functions taking place at the premises that may be attended by persons other than members of the Club and their bona-fide guests (limited to a maximum of two per member), a written risk assessment shall be undertaken to determine whether it is necessary to employ SIA registered door supervisors for the duration of or part of the function. If the risk assessment indicates that it is necessary to employ door supervisors, such supervisors shall be employed if the function takes place. A copy of the relevant written risk assessment shall be provided to the licensing authority and/or the Police upon request.
8) Notwithstanding clause 7 of this part, if the premises or any part thereof is hired out for a private function (i.e. a function that has not been organised by the club) involving music and/or dancing as regulated entertainment and the majority of those attending are not members then at least one SIA registered door supervisor shall be employed from no later than 21:00 hours until at least 30 minutes after the function ends and if the guest list submitted in advance of the function indicates an attendance of more than 50 persons, a minimum of two door supervisors shall be so employed. If only one door supervisor is on duty at such a function, then no more than 50 persons shall be permitted admission to the function in any event.
9) Licensable activities must cease at least 30 minutes before the premises close each night but during this period, non-alcoholic drinks must be available to patrons.
10) Either the Designated Premises Supervisor or a member of the Club’s committee shall be physically present at the premises whenever any event or function is taking place at which non-members are present (excluding non-members who are bona fide guests of members).
Public Safety
11) The maximum number of people permitted in both the members bar and the function room/skittle alley respectively shall be limited to 250 in each, this to include all staff.
The Prevention of Public Nuisance
12) Whenever regulated entertainment is taking place in any part of the premises, the holder of the licence shall ensure that within that part or parts:
All doors and windows are kept locked closed other than as may be required for emergency purposes and normal access and egress and in any event, not kept or locked open.
A noise limiting device is installed, fitted and maintained in good working order so as to control all sources of amplified music at the premises.
13) Clear and prominent notices shall be displayed at all relevant exit points from the premises requesting patrons to respect the needs of local residents and not to cause unnecessary noise when they leave.
14) All external areas, including in particular the car park, shall be managed and supervised whenever the Club is open so as to ensure as far as it is reasonably practicable to do so that they are not used for ball games, skateboarding or other activities that might cause a nuisance to the occupiers of nearby noise-sensitive premises.
15) The barrier to the car park shall be maintained and securely locked no later than one hour after the premises close each day.
16) All acoustic measures in place at the premises, including double or secondary double glazing, automatic closers to internal doors, acoustic seals and sound-proofing shall be maintained so that noise breakout from the premises does not cause a nuisance to the occupiers of nearby noise-sensitive premises.
The Protection of Children from Harm
17) The responsible person shall ensure that the premises does not host or provide facilities for birthday parties for persons aged 16 to 18 years.
18) The mandatory age verification policy shall apply from 26th May 2010 , rather than 1st October 2010 which states:
The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
