Additional Conditions
Film Exhibitions The admission of children must be restricted as follows: 1) Where the film being exhibited has been classified by a body designated under section 4 of the Video Recordings Act 1984, admission of children ie. persons under 18 is restricted in accordance with any recommendation made by that body. 2) Where the film being exhibited has been classified by the licensing authority itself, the admission of children ie. persons under 18 is restricted in accordance with any recommendation made by the licensing authority.
Sale of Alcohol 1) No supply of alcohol may be made under the premises licence: a) at a time when there is no designated premises supervisor in respect of the premises licence; or b) at a time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended. 2) Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence. 3) (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises. (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children: (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to: (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or (ii) drink as much alcohol as possible (whether within a time limit or otherwise); (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act); (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less; (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on: (i) the outcome of a race, competition or other event or process, or (ii) the likelihood of anything occurring or not occurring; (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner. 4) The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability). 5) The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available. 6) (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol. (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark. 7) The responsible person shall ensure that: (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures:- (i) beer or cider ½ pint; (ii) gin, rum, vodka or whisky 25ml or 35ml; (iii) still wine in a glass 125ml; and (b) customers are made aware of the availability of these measures.
Any individual employed to carry out a security activity must be licensed by the Security Industry Authority.
Refer to plan dated May 2006 drawn by Robert Murray and Associates Ltd on a scale of 1:100 (submitted as part of an application to vary a premises licence under Section 17 of the Licensing Act 2003 dated 11th July 2006) which forms part of this licence and should be read in conjunction with it. N.B. The plans submitted by the premises licence holder incorporates proposals in respect of the following public safety measures means of escape, fire detection, fire fighting equipment and emergency lighting.
Prevention of Crime and Disorder (1) All door staff will wear a high visibility coat or vest/tabard. There shall be a minimum of 2 SIA door supervisors from 22:00 hours, each Friday and Saturday evenings in the months of April, May, June, July, August, September and December. In addition, door supervisors will be provided from 22:00 hours on each day that regulated entertainment in the form of a DJ or live band is provided at site. A minimum of 2 door supervisors will also be employed on New Year's Eve from 22:00 hours. On occasions when doors supervisors are required, they will be deployed at a ratio of 1:100 with a further 1 for each additional floor open to the public (this would not apply on occasion when additional floors are utilised solely for pre-booked private functions)" (2) The holder of the premises licence will ensure that the company's Drugs Policy is implemented, and a copy retained at the premises for inspection by the Police or an Authorised Officer. (3) The holder of the premises licence will ensure that drinks promotions will not be permitted allowing unlimited supply of alcohol for a set price. (4) The holder of the premises licence will ensure that a representative will actively participate in a Pub Watch scheme where such a scheme exists. (5) All drinks will be dispensed and served in polycarbonate vessels from 22:00 hours each Friday, Saturday, New Year's Eve, Bank Holiday Weekend (Friday to Monday) and during any promotion or event where regulated entertainment is provided. (6) CCTV shall be installed on the premises and maintained in good working order at all times with a minimum of 28 days continuous recordings. All cameras must be tamperproof, and all equipment shall have a constant and accurate time/date generation. There must be sufficient cameras able to cope with operating illumination and located to cover all public areas, including external areas and coverage of entrances. The camera(s) covering the main entrance(s) must be to identification standard, and capable of providing good quality head and shoulder images. The remaining cameras must be capable of recognition. All external cameras shall be fitted in weatherproof housing. There shall be sufficient members of trained staff available during hours of operation to be able to download/copy recordings at the request of the Police or an Authorised Officer. Prevention of Public Nuisance (7) The holder of the premises licence will comply with the reasonable requirements of the environmental health officer, to include matters relating to acoustic measures, noxious smells, and refuse. (8) The holder of the premises licence will ensure that notices asking patrons to leave quietly shall be displayed at the premises. Protection of Children from Harm (9) The holder of the premises licence will ensure that persons under the age of 16 will only be permitted entry to the ground floor at the premises when trading if accompanied by an adult. (10) The holder of the premises licence will ensure that persons under the age of 18 will not be permitted to play the amusement with prizes machines. (11) The holder of the premises licence will ensure that: (a) the admission of children is restricted in accordance with the following recommendations: U Universal. Suitable for audiences aged 4 years and over; PG Parental Guidance. Some scenes may be unsuitable for young children; 12A passed only for viewing by persons aged 12 years or older or persons younger than 12 when accompanied by an adult; 15 passed only for viewing by persons aged 15 or over; 18 passed only for viewing by persons aged 18 or over. (b) where the film being exhibited has been passed by the British Board of Film Classification, a reproduction of the certificate is to be shown on the screen for at least 5 seconds in such a manner as to be easily readable by all persons in the auditorium; (c) where the film exhibition includes a trailer advertising a film, a copy of the statement approved by the British Board of Film Classification is to be exhibited on screen.;
Prevention of Crime and Disorder (1) The holder of the premises licence will ensure that Staff training as to the prevention of sales to underage persons. All staff employed at the Premises to sell alcohol shall receive training, prior to serving at the bar for the first time and during induction at the bar and thereafter at least once every three months, in the responsible retail of alcohol to include instruction on the prevention of under age sales. Such training shall be recorded and training records shall be made available upon request to the Police or Trading Standards officers. (2) The holder of the premises licence will ensure that the existing electronic till system recording under age challenges and refusals shall be operated at the Premises. Records of challenges and refusals shall be kept for a period of six months and the related CCTV footage for a period of 30 days and made available upon request to the Police, Trading Standards or Enforcement officers, such records being checked by management quarterly with hard copies of such management checks themselves being kept for a period of three months. (3) The holder of the premises licence will ensure that: (a) proof of age is required for any sale/supply of alcohol that takes place where there is a suspicion on the part of the person selling or supplying the alcohol that the customer is under 21 years of age (Challenge 21); (b) proof of age is required when the presence of children is restricted to all or part of the premises, or at certain times; (c) such proof of age conforms to the PASS accreditation system or photo ID (photo driving licence or passports).
