• ANNEX 1 - MANDATORY CONDITIONS

   

  Sale of Alcohol

   

  1)              No supply of alcohol may be made under the premises licence:

               

                a)              at a time when there is no designated premises supervisor in respect of the premises licence; or

                b)              at a time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.

               

  2)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  3)              (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

                (2)              In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children:-

               

                (a)               games or other activities which require or encourage, or are designed to require or encourage, individuals to:-

                              (i)               drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

                              (ii)              drink as much alcohol as possible (whether within a time limit or otherwise);

               

                (b)               provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

               

                (c)              provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

               

                (d)              provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on:-

                              (i)               the outcome of a race, competition or other event or process, or

                              (ii)              the likelihood of anything occurring or not occurring;

               

                (e)              selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

               

  4)              The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

               

  5)              The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

                             

  6)              (1)               The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

               

                (2)               The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

               

  7)              The responsible person shall ensure that:

               

                (a)              where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures:-

               

                              (i)               beer or cider - ½ pint;

                              (ii)               gin, rum, vodka or whisky - 25ml or 35ml;

                              (iii)               still wine in a glass - 125ml; and

               

                (b)              customers are made aware of the availability of these measures.

   

  Door Supervisors

   

  Any individual employed to carry out a security activity must be licensed by the Security Industry Authority.

   

   

   

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  Crime and Disorder

   

   

  (1) All door staff will wear a hi-visibility coat or vest/tabard. There shall be a minimum of 2 SIA door supervisors from 23:00 hours each Friday, Saturday, New Years Eve, and during any promotion or event where regulated entertainment is provided. Door staff will be deployed at a ratio of 1:100 with a further 1 for each additional floor open to the public.

   

  (2) CCTV shall be installed on the premises and maintained in good working order at all times with a minimum of  21 days continuous recordings. All cameras must be tamperproof, and all equipment shall have a constant and accurate time/date generation. There must be sufficient cameras able to cope with operating illumination and located to cover all public areas, including external areas and coverage of entrances.  The camera(s) covering the main entrance(s) must be to identification standard, and capable of providing good quality head and shoulder images. The remaining cameras must be capable of recognition. All external cameras shall be fitted in weatherproof housing. There shall be sufficient members of trained staff available during hours of operation to be able to

   

  (3) No alcoholic beverages, bottles or glasses shall be taken from the premises, except for off sales in sealed containers for consumption off and away from the premises (excluding any outside area that is contained within the premises licence).

   

  Prevention of Public Nuisance

   

  (4)              Each external door opening from the area covered by the Licence to the outside must be kept closed whilst music or any amplified sound is being played/produced.  If the external doors are required for the entrance or exit of clients, there must be a lobby to prevent breakout of noise with at least one set of internal doors and at no time shall both the external and internal doors be open at the same time. No measures whatsoever, whether by pinning back, propping open or other means, are to be taken to keep either set of doors open.

   

  (5)              Where amplified music (either recorded or live) is being played a tamper-proof sound limiting device must be installed at the premises to the level set in agreement with the Council.  All amplified music (either recorded or live) played on the premises must be subject to the control of the sound limiting device.

   

  (6)              The noise limiting device installed must control the power circuits used by both live musicians and also by any disco music provided every time music is being played

   

  General

   

  (7) All staff will be trained upon induction and at least every 6 months thereafter, regarding their lawful and social responsibilities for the sale and consumption of alcohol. A written record of training will be kept at the premises, and made available upon request to a Police or Authorised officer.

   

   

• ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

  Weymouth Magistrates Court added the following by Consent Order on 27th July 2009

   

  The Premise Licence for the Dorothy Inn shall be varied in accordance with the following changes:

   

  1)              The sale of alcohol by retail (including residents and guests) shall be restricted to 8:00am to 6:00am daily.

   

  2)              On New Year’s Eve the provision of all licensable activities at the premises shall be restricted from 8:00am to 8:00 am on New Year’s Day.

   

  3)              With the exception of New Year’s Eve the premises shall be permitted to be open to the public from 6:00am to 8:00am daily for the provision of food only.

   

  4)              The following condition shall be imposed on the Premises Licence:

   

  By 6:20am daily the Premises Licence Holder will ensure that all bottles, glasses and any other drinking vessels containing any alcohol or that have contained alcohol shall be taken off of customers, cleared away and removed from any area of the premises accessible to the public.

  Refer to plans on a scale of 1:100 with the licensable areas highlighted (submitted as part of an application to convert an existing licence to a premises licence under Schedule 8 to the Licensing Act 2003 dated 9th May 2005) which forms part of this licence and should be read in conjunction with it. 

   

  Additionally from 30 June2011 the area denoted by sitting out licence 036, as issued by WPBC, is included as part of the premises licence.
